These Terms & Conditions (“Terms”) govern your access to and use of the website https://maggieslegacy.com.au (the “Site”) and the Maggie’s Legacy App (the “App”), and any related services, courses, community functions and content provided by Maggie’s Legacy (“we”, “us”, “our”). By accessing or using the Site/App you agree to be bound by these Terms. If you do not agree, you must not use the Site/App.

  1. Definitions
  • “User”, “you”, “your” means any person who accesses or uses the Site/App.
  • “Content” means any text, graphics, images, audio, video, courses, community posts, tools, files, and other materials made available via the Site/App.
  • “Services” mean the courses, community functions, support materials, and other functionality that we make available via the Site/App.
  1. Acceptance and modification of Terms
    We may revise these Terms at any time by posting an updated version on the Site or App. The “Last Updated” date will reflect when the Terms were last changed. Your continued use of the Site/App after any changes indicates your acceptance of the updated Terms. It is your responsibility to review the Terms regularly.
  2. Access and use of the Site/App

  • If you contribute user-generated content (for example posts in the community, comments, feedback), you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, modify, publish and distribute that content in connection with the Site/App and our business.
  • You represent and warrant that you own or have the right to provide any user content and that it does not infringe any third-party rights or violate applicable laws.
  • We reserve the right to remove or refuse to display any user content in our sole discretion.
  1. Intellectual Property
  • All Content on the Site/App (including text, graphics, logos, icons, images, audio/video clips, software, courses) is owned by us or licensed to us, and is protected by copyright, trademark and other intellectual property laws.
  • You may not reproduce, distribute, modify, transmit, republish, display, licence, create derivative works or otherwise exploit any of the Content without our express prior written permission.
  • The “Maggie’s Legacy”, “Maggie’s Legacy App” names and logos are our trademarks; you may not use them without our prior written consent.
  1. Courses, Subscriptions and Payments
  • Some Services (for example premium courses, subscription access) may require payment. If you pay for access, you agree to the specific payment terms, renewal terms, cancellation terms and refund policy we provide at the time of purchase.
  • All fees are payable in Australian Dollars (unless otherwise stated) and exclude any applicable taxes (which you are responsible for).
  • We reserve the right to change pricing at any time, but such changes will not affect already purchased access unless otherwise notified.
  1. Disclaimers and Limitation of Liability
  • To the maximum extent permitted by Australian law, the Site/App and all Content and Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not warrant accuracy, completeness or reliability of any Content, or that access to the Site/App will be uninterrupted or error-free.
  • In no event will we, our officers, directors, employees or agents be liable for any indirect, incidental, special, consequential or punitive damages (including loss of profits, data, revenue, goodwill) arising out of or in connection with your use of or inability to use the Site/App or Services. Our total aggregate liability to you for any claim under or in connection with these Terms is limited to the amount (if any) you have paid us in the previous 12 months for the Services giving rise to the claim.
  • Nothing in these Terms excludes or limits liability that cannot be excluded under the Australian Consumer Law or other applicable laws.
  1. Indemnity
    You agree to indemnify and hold harmless Maggie’s Legacy, its officers, directors, employees and agents from and against any claims, demands, liabilities, losses, expenses (including legal fees) arising out of your breach of these Terms, your misuse of the Site/App, your user content, or your violation of applicable laws or third-party rights.
  2. Links to Third-Party Sites and Services
    The Site/App may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy practices or terms of those sites. Your use of any linked third-party site is at your own risk, and we encourage you to review their terms and privacy policies.
  3. Termination
    We may terminate or suspend your access to the Site/App (or any part) immediately and without notice if you breach these Terms or we suspect misuse. On termination, you must cease all use of the Site/App and remove any copies of downloaded material (if any). Sections of these Terms which by their nature survive termination (such as indemnity, disclaimers, intellectual property, limitation of liability) will continue in full force.
  4. Changes to the Site/Services
    We reserve the right to modify, suspend or discontinue the Site/App (or any part) or any Service at any time for any reason without liability to you. We may also add new features, remove or change existing features.
  5. Governing Law and Jurisdiction
